Cruel? No. Unusual? No.

It was creative, and not anymore cruel than being in jail getting butt-raped.

I`ve always wanted to pull up next to one of cars with the thumping bass playing classical music and looking right at them and nodding my head.

"Only rap is played extremely loud, hate to come off racist but I don`t hear see a car bouncing next to me playing Beethoven with the windows rolled down."
Then you`ve never seen me drive my pooty car.

***

You`ve never seen me drive with my best friend either. First movement of Mahler`s 5th? Subwoofer goes BRRRUUUUUMP, windows go down. We hope for stoplights when we`ve got it going like that. Why yes, we are nerds, why do you ask? *grins*

hate to bring this up, but what the judge did was illegal.

the eighth amendment of the constitution protects the defendant from cruel and unusual punishment, and there is no denying that this is an unusual punishment, and it`s attempts could be seen as cruel.

If I was the man I would have appealed the ruling, and have the fines totally removed.

-----

Are you serious? GROW UP. The guy got off easy with the offer.
Besides, the judge did not FORCE him to listen to the music. He offered it as a plea bargain, which is LEGAL.
Besides there`s a difference between Cruel and unusual punishment as compared to just unusual punishment. Get your facts straight, go to law school first, and THEN claim what you want.

"I didn`t have the time to deal with that," he said. "I just decided to pay the fine."

Call me bigoted, but I`m imaging the actual statement went something a little more like:

"Ah didn`t have da time tuh deal wid dat. Ah just `cided tuh pay da fine."

"Oh... I see what you did. You got the C from country and added rap at the end. That was very clever. Did you think of that.... all by yourself?"
No, I helped him.

Where does country come from? it has NOTHING to do with this article and you, sir, are retarded. The LEAST you could do was say that contemporary rap is crap instead of being an idiot.

Wow...8,000 MP3s on my computer....hmm...only 2 of them are Rap....the remaining most people probably wouldn`t want to listen to here anyways...video game soundtracks, classical, yodeling, techno...yeah, you name the genre, I probably have it. (And most of the MP3 was ripped from my extensive CD library to boot...so I bought the music, so I am supporting the artists which made yodeling, and video game soundtracks as well!)

"So then if he was listening to classical really loud, would he get assigned to listen to rap music?"

.... *adds Beethoven to playlist

And I dont necessarily mind the punishment, I just think it was a bit too long.

"Rap is anti-music, and it`s popularity among the ignorant masses is only helping the downfall of the arts.

drat the ignorant, they are destroyers of beauty."

So young, so angry, damn that rock music!

And as to what you said:
Same thing can be said about fancy, you dont see us complaining

and yes I am aware he only made it 15 minutes into the "punishment". Still doesn`t change what the judge was trying to do.

Let`s see..

His fine was only $135, but the judge was going to reduce it by $100 and make him listen to 20 hours of Classical. To do this she had to have a probation officer over see the administration of the Classical Music.

What a damn waist of tax payer dollars. Lets use up the resources of the system so we can make sure some guy listens to Classical Music. It is this kind of crap that adds to the current financial crisis in the states as it is. Make the guy pay the full $135, tell his ass to keep the music down and move on! Absolute waist.

"Classical rap.
Clap?"

I was thinking more along the lines of "Crap". Though, the same can be said about regular rap too. Modern regular rap, that is. Oldschool rap is badass.

God, even elected officials openly vent their hatred of an entire culture. "No, son. Listen to WHITE music." Twenty-first century, folks. Get used to it. It`s been around for a hundred years in some form, and this form has been around thirty quite productive years. It`s not going away anytime soon. Better get used to it.

This sentence raises the question of whether the constitution meant "unusual" to be a synonym of "cruel", or if the constitution writers and collaborators really didn`t want unusual punishment. Because this forced classical music listening is pretty unusual.

And Nidonemo: "...punishment should reflect the crime."

In what aspects? Because, if you are suggesting that punishments should be similar to the crime committed, then you also must be suggesting the greater "eye for an eye" policy. If this is the case, please know: "An eye for an eye makes the whole world blind." - Mahatmas Ghandi ^^

I wouldn`t last fifteen minutes listening to rap music.

And the is further proof that the `unusual` part of the Eighth Amendment can be abused with hilarious results.

Dude i would love it if i was sentenced 20 hours listening to Classical Music (Even Though Bach was Baroque)

I would ask if they would use Yngwie Malmsteen & Paul Gilbert`s version of their songs though

`She`s also taped TV shows for defendants in other cases to watch on topics such as financial responsibility. As she sees it, they get the chance to have their fine reduced "and at the same time broaden their horizons."`

Excellent! I`m always a fan of the legal system realizing it can try to better its citizens` lives instead of just exercising power over them
