I hate to say this but, I have a close friend whom when he was 16 was driving in a car and the tire blew out. The accident that it caused resulted in him having severe closed head trauma, coma for two months, partial paralysis, tremors, etc. He has suffered for the past thirty one years. So I do believe that manufacturers of products sold to the public do have a responsibility to ensure their products are safe.
However, that being said, I would like to make a couple of observations about this case.
1. She seemed to almost laugh a couple of times ,and that, along with her answers and overall appearance did not indicate that she was sincere.
2. Lawsuits should be capped to the extent of the provable injury. I can tell you that she will probably get much, much more than my friend did even though her injury, if true, is miniscule in comparison. THis being due to the proliferation of lawsuit over the last few decades.

Keep in mind that she had this accident over a month ago. She was in pain! She ate a lot of ice-cream. She was a size zero then she was injured by VS and BAM!

suing a huge company for a defective thong??? those people rolling their eyes are doing the right thing.
Now, I think that consumers do have some responsibility for their own safety, but at the same point and time I believe that the quality of products has been seriously lowered within the last few decades.
The attorney did the talking most likely so the client would not say anything that shouldn`t be said before the trial.
But since she had worn it before, that probably won`t help her case because VS could say that it was damaged in the wash, or from normal wear and tear.
Either way; if I bought a thong and put it on the first time and the decoration snapped off and the securing fixture lacerated my cornea, I would sue just as this woman is doing.
I don`t think it`s stupid - I think it`s the right thing to do.
Would you all be saying the same thing if it were a mother suing the company of a car seat for the buckle snapping off and hitting her kid in the eye?
It`s up to the manufacturer to make sure that the product is reasonably safe if used as intended. I`ll leave it up to the judge to decide if in this case it is "reasonably safe."
This is a litigious society, deal with it or move.
But yeah, either she ordered the product in the wrong size, or they delivered her the wrong size [assuming it`s delivered and not store-baught]. I love it how she was choosing her words so carefully wen she was saying she only wore it once or twice. V.S. manufacture and sell lots of underwear like that. They have probably sold millions of that exact style. It`s only broken for her/she`s the only one that`s broken it, or, she`s the only money-hungry one there. It didn`t blind her. She should be greatful. >.>I hope she does loose though. Seriously.
it`s pitiful that VS would even let her walk out of the store with the thong! (maybe she bought it online...which doesn`t give the "omg she`s buying that?" look.)

I know I am. Notice how he dodged the question about the money they`re seeking. "Above $25,000" -- I`ll bet they`re asking for A LOT more than that.
2) Why even buy something like that, if anything it`d be uncomfortable in the first place.
