THIS IS RIDICULOUS! I HAD TO DO COMMUNITY SERVICE FOR MY TICKETS, IT`S WAAAAY BETTER THAN PAYING UP. I WAS SUPPOSED TO DO LIKE 100 HRS CS BUT I ACTUALLY DID LIKE 18HRS. ALWAYS CHOOSE THE COMMUNITY SERVICE OPTION!!!

Although the judge did have the right to demand payment immediately the judges sentence was contrary to the statute stating that a first time offense is not punishable by more than a $75 fine plus court fees, which is addressed by another statute.The judges argument for the jail sentence was based on imposing the alternate sentence imposing jail time up to 1 year or until which time the fine was paid or 5 days of the sentence was served because, for some strange reason "probation" was not imposable. No, the mindset of the judge does not make any sense and throws up a red flag regarding competency. The judge did not ask the defendant what amount of the fine she could pay nor offer community service in alternative to payment. The judge could of been within her rights to impose contempt of court and jail her until which time the fine was paid as well. It`s the judges choice. Regarding the defendants record the misdemeanor is

They need to change that law. A few days in jail will get people to pay more attention and not drive illegally. She should`ve spent the 5 days there, I`ll bet she would stay out the HOV lane next time.

Gotta say, didn`t watch most of it, but from what I can tell:

Lady made a mistake.
Lady gets ticket.
Lady can`t pay ticket.
Lady goes to jail.

Unless Lady didn`t know she would have to pay at the trial, there`s nothing wrong with this. If you can`t pay a ticket, you`re held for a few days. The end. What am I missing?

Which is where the judge probably messed up... The laws vary from state to state, and how a judge chooses to use or not use the power granted to them by the law will vary greatly also.

All courts offer payment plans? Yeah I suppose.. You pay or you end up in jail - if you call that a `plan`.

In checking Georgia law, I found two interesting things:
"15-21-1. Time of payment of fines
Every fine imposed by a court under the authority of this Code shall be paid immediately or within such reasonable time as the court may grant."

In other words if the judge wants it now, the judge gets it now, or you suffer some sort of consequences.

well apparently you`ve never gotten a ticket because all courts offer payment plans. i`ve never even heard of a judge themselves asking about money to pay a fine. they usually announce the fine and send them to the clerk and recorders office to pay it/set up a payment plan. that judge was out of line and needs to be removed. small disregards for protecting the laws can lead to big trouble.

Just to be clear, she was NOT sentenced to jail for her lane violation. She was fined $119.25 ($75 fine + court costs). It was her failure/inability to PAY that landed her in jail.

If you get a parking ticket, and don`t pay the fine, a bench warrant will be issued and you will be arrested for failure to pay. You haven`t been `sentenced to jail` for a parking ticket....

HOV is an acronym for High Occupancy Vehicle. They are also referred to as carpool lanes. These lanes will have a diamond marking and are sometimes called "diamond lanes."
