its not COPYRIGHT INFRINGEMENT, as someone above me said its a tribute song,the peppers are paying respect to not only tom petty,who is an amazing artist,but if you have seen the video he also elvis,beatles,sid vicious i think....,montley crue,and nirvana. all this is, is a tribute song not copyright infringement

Even though sampling does happen often in the Hip Hop/R&B industry, it doesn`t make it right. To take credit for someone else`s work or even a sample of their work, and claim it as your own without asking for permission and giving them credit it illegal. To be more specific the term is COPYRIGHT INFRINGEMENT.
There are dozens of lawsuits pending as we speak. J. Lo actually has numerous suits against her, (Ex. Flashdance ppl are suing for her copy of their dance moves in her video "I`m Glad", Debora Laws went after Jlo and LL after they remade Very Special.)
Not to mention Truth Hurts. Her career is over after a $500 million dollar lawsuit against her, the record company, dr. dre, and dj quick (who is mostly responsible for stealing the music.)

oh and the guy that said they took the drum beat from another song... i myself sir, am a drummer. maybe you have to be a drummer to understand it, but there`s only so many base beats you can roll with. a lot of songs have the same beat, it`s the fills, the solos, the interpretation that changes to make it sound different and make it unique.

although i`m an rhcp fan it seems like they did copy it a bit. in tom petty`s song he talks about indiana at the beginning of the song, and rhcp talks about indiana as well at the beginning of dani california. it just seems like too much of a coincidence. theyre both great songs either way.

Chili Peppers rock even if they were "infulenced" I don`t think they`d rip anyone off though.
Nothing goes better with a summer day than an RHCP cd.
And, yeah, Dani California is a great single; I cant get it out of my head (not as much as "She`s Only 18" now that is some good stuff)

Wheter it was intentional or not, they made a very similiar song. I dig both TP and RHCP, but I must side with TP on this one.
This happens a lot. It`s not that big a deal. So RHCP will have to pay TP some royalties...big whoop. I`m pretty sure they have enough money to spare.

alright ladies and gentlemen. let me lay this down for ya. First thing first, the Tom Petty song was sped up for that to make it sound more alike, when in truth it`s much slower.

The chords are different. Mary Jane goes to D minor as it`s last chord, and Dani C goes to D Major, giving them a totally different feel.
They never showed the chorus of Mary Jane, which is absoloutely nothing like Dani C at all.
The chord progression that both songs use is common, and the 4/4 beat is EXTREMELY common, both of these chord progressions are used in SO MANY EFFING "rock" songs today, you hear them everywhere. Final Thoughts: The peppers said before the album was released that it sounded a lot like `sweet home alabama` and they go the idea for the drumbeat from a wutang song. you get the idea. its easier for me to judge this song UNBIASED because i absolutetly love both groups. Now, does anyone know of anywhere I can get an embeddable player of this?!?!

drat all of you hating on RHCP, they have been through more poo in their life than Tom Petty will ever begin to imagine. they did NOT copy off of Tom Petty, im pretty sure they would have said something about it if they did. there is no need to say RHCP suck and that Tom Petty is better than them, no one has said that Tom Petty sucks now have they? Tom Petty and RHCP are some of the biggest artists in the world today, they both deserve the same amount of respect for each other, they have both changed the world with their music and dont need to be dissed and put down the way you people have been putting RHCP down.

I am a huge fan of Tom Petty and the Heartbreakers. When i heard this dani californian song i knew right away maryjane was stolen or borrowed. You can not assume because RHCP have had success that they would never steal music. George Harrison did it and he is far more influential and successful than RHCP. If this song was meant to be flattering or a tribute they should have asked Tom Petty before hand. Many artists have done this, Sheryl Crow did it with "The First Cut is the Deepest" originally a Cat Stevens song. I believe that RHCP didnt sit down and say "Lets steal this song" but i think they were influenced by it however they went about recording it the wrong way. Dani California is a poor attempt at remaking, tirbutizing, etc maryjane. the song isnt even that good. Last dance is a classic and this RHCP song falls short of even a good song. I cant believe they let this be their single. that should piss people off more.

Haha, you know, that`s what I thought the first time I heard Dani California. Oh, well... it happens all the time. I heard this Rihanna song the other day - parts of it seemed exactly like Achy Breaky Heart and parts seemed like Rob Thomas` Lonely No More. That doesn`t mean her songwriters ripped off those songs. Often songs that resemble one another are due to coincidence. You never know... maybe the RHCPs were listening to a Petty record the night before this was written and they subconsciously were influenced by it.

Actually, to be completely honest, I`ve always thought that Tom Petty sounded too much like Bob Dylan. Nobody sounds like Anthony though.
Sure, the songs are similar. It could have been a coincidence or the peppers could have copied it whether purposly or accidentally. But anyways, it doesn`t really matter, the media is giving it way too much attention, and nothing could ever amoung to something so blatant as, "Thiers goes ding ding ding dingy ding ding"

kitten soup, you know what i love? i love how you think your being wise by saying the chilli peppers suck and tom petty is a "grown up", when really all your being is ignorant. i hope your "wise" enough to realize that just because your not into the chilli peppers doesnt mean they suck. And what i find "laughable" is the fact that you make an attempt to sound cool by acting as if you know Tom Petty by saying he`s got a good sense of humor and hes NOT going to sue. When in reality, Tom Petty is not going to be the person who would sue the peppers, it`s his producers (along with tom of course) but in the end, the producers who have the rights to all Petty`s music make the executive decision to sue or not. And i can assure you their sense of humor has nothing to due with their decision to sue or not. ;-)

Not really. The "D" in Petty`s becomes a "D-minor" in Red Hot Chili Peppers`. So, if you count the difference as well, a half-step, from F# to F, then yes--they`re very different.

if you had the Stadium Arcadium box-set with the DVD where they interviewed the band about every song on the album, you would know that they took the drum beat from a Wu Tang Clan song, and they had no mention of Tom Petty EVER, and they said that the song sounds more like Sweet Home Alabama

Kind of like the lesser known tune "Der Komissar" (sp?) that came out in the 80`s and "Superfreak". Both sound quite alike. Always sucks because I think it`s the first one coming on when it`s just the overplayed "Superfreak". Ah wells.

Never liked the "Dani CA" song anyway. RHCP only have a very few songs that are good. Metallica`s better. So is Pavarotti for that matter.

they are similar, veerry similar. but the chord progression is different. and however, any one who is fimiliar with the peppers will know that all their stuff has the same "sound" and this is that sound. and there is no way the peppers and their producers would purposely steal music from TOM PETTY, they would realize that there`d be no way they could get away from it. anyway what im really typing this for is because i want to know if anyone knows where i can get the embedded link for this? im trying to post it up somewhere else, help?

Btw, it isn`t Tom Petty accusing the RHCP, it`s the radio presenter. They aren`t actually being sued. Not yet anyway, but if it did go to court I doubt much would be done, it`s really more the intro than anything that sounds the same, if you listen to both songs all the way through they sound a lot less alike.

Okay, based on input above, I googled and found a couple of camparisons with audio. I would say the verses are very similar, musically and even thematically, but there`s a pretty significant difference between the choruses (melody and performance-wise).

I`m no lawyer, but, the way I understand copyright for music, you can have the same chord progression, same key, etc., as there are limited combinations. However, you cannot have the same melody. Here, the verses, to me anyway, DO have the same melody, but not the choruses. So, we`ll see I guess. George Harrison got successfully sued for "My Sweet Lord" so, it`s certainly possible.

dude... they may sound the sound but they did not copy him, theyre smarter than that... the chord proggression is different, and the solo is different, and for those who say that the solo is a cop of Jimi Hendrix`s "Purple Haze" thats because the guitarist, John Frusciante, was intentionally quoting him, its in a different key and the 4th note is different... all in all if Tom Petty sues RHCP then RHCP should sue Crazy Town for stealing the RHCP`s "Pretty Little Ditty" guitar part.
